Legal Basis

Pursuant to RA 6969 (Toxic Substances and Hazardous and Nuclear Waste Control Act of 1990), Section 14, Chapter IV, Title II of DENR Administrative Order No. 29 Series of 1992 (IRR of RA 6969), and other applicable laws.

SECTION 1. Basic Policy

It is the policy of the State to regulate, restrict, or prohibit the importation, manufacture, processing, sale, distribution, use, and disposal of chemical substances and mixtures that present unreasonable risk and/or injury to health or the environment; to prohibit the entry, even in transit, of hazardous and nuclear wastes into Philippine territorial limits for whatever purpose; and to provide advancement and facilitate research and studies on toxic chemicals.

SECTION 2. Objective

To develop, keep, update, compile, and maintain the PICCS for information of government, industry, and the public on chemicals and chemical substances imported, used, processed, manufactured, or transported in the country.

SECTION 3. Scope and Coverage

Covers: (3.1) Existing chemicals in the PICCS; and (3.2) New chemicals imported or manufactured with issued PMPIN Compliance Certificate and submitted Notice of Commencement.

SECTION 4. Key Definitions

• New Chemical - any chemical substance imported into or manufactured in the country not included in the PICCS as published by the DENR
• Notice of Commencement - document filed after the first commercial importation or manufacture of the new chemical
• PICCS - list of all existing chemical substances stored, imported, exported, used, processed, manufactured, or transported in the Philippines. Contains Chemical Name, Chemical Abstract Registry Number (CAS RN), and CAS Registry Index Names per IUPAC nomenclature
• PMPIN (Pre-Manufacture, Pre-importation Notification) - notification process/document for new chemical substances submitted for review to the DENR

SECTION 5. Updating of PICCS

The PICCS shall be updated annually. Importers and manufacturers who submitted Notice of Commencement on or before December 31 of the current year will be listed for the subsequent year.

The current PICCS is expanded from 22,277 to 22,438 chemicals, with 96 new chemicals in CY 2022 and 65 new chemicals in CY 2023 (Annex A). The list of new chemicals shall be released annually and made available through the EMB Website (chemical.emb.gov.ph) and the Online Permitting and Monitoring System (opms.emb.gov.ph).

SECTION 8. Effectivity

Takes effect fifteen (15) days after publication in a newspaper of general circulation and upon acknowledgment by ONAR.
