Legal Basis

Pursuant to Sections 16.1.2 and 24.5 of DAO 2023-02 (IRR of RA 11898, the EPR Act on Plastic Packaging Waste, amending RA 9003 / Ecological Solid Waste Management Act of 2000) and DOF-DBM-NEDA Joint Circular No. 1-2013 (IRR of Administrative Order No. 31 s. 2012 on Rationalization of Rates of Fees and Charges).

SECTION 1. Basic Policy

State policy to adopt a systematic, comprehensive, and ecological solid waste management program ensuring protection of public health and environment, sustainable use of natural resources, and promoting ecological solid waste management and resource conservation throughout the country.

SECTION 2. Objective, Scope and Coverage

Prescribe a schedule of fees for EPR Program Registration applicable to Obliged Enterprises (OEs), Collectives, and Producer Responsibility Organizations (PROs) mandated under RA 11898.

SECTION 4. Updating of Fees

The Department shall periodically update the schedule of fees based on market and inflation rate to cope with the cost of regulation.

SECTION 7. Effectivity

Takes effect fifteen (15) days after publication in a newspaper of general circulation and upon acknowledgement by ONAR.
